These general conditions of sale (hereinafter the "General Conditions" or "GTC") apply to any purchase made by a natural person (hereinafter the "CUSTOMER") on the website https://www. drawyourbliss.com/ (hereinafter the "WEBSITE") with Barbara MULLER manager of DrawYourBliss (hereinafter the "SELLER").
The SELLER sells through her WEBSITE handmade stationery items as well as other items illustrated by Barbara MULLER, creator and manager of DrawYourBliss.
These General Conditions are intended to govern the sale and DELIVERY of PRODUCTS ordered from DrawYourBliss via the WEBSITE.
They are accessible and printable at any time via a hypertext link available on the WEBSITE's bottom page.
IMPORTANT
ANY ORDER MADE ON THE WEBSITE MANDATORY IMPLIES THE UNRESERVED ACCEPTANCE, BY THE CUSTOMER, OF THESE GENERAL CONDITIONS OF SALE.
ARTICLE 1. DEFINITIONS
The terms, used below, have in these general conditions of sale, the following meaning:
CUSTOMER: means the co-contractor of the SELLER, who guarantees to have the status of consumer/private customer as defined by French law and case law.
ORDER: refers to the purchase of PRODUCTS by a CUSTOMER from the SELLER on the WEBSITE.
DELIVERY: refers to the production of the first presentation of the PRODUCTS to the DELIVERY address indicated by the CLIENT when ordering.
PRODUCTS: all the goods offered for sale on the WEBSITE.
WEBSITE: refers to the website accessible at the address www.drawyourbliss.com and includes all hosted web pages and PRODUCTS offered to the CLIENT.
SELLER: refers to Barbara MULLER offering the PRODUCTS for sale on the WEBSITE www.drawyourbliss.com
ARTICLE 2. PURPOSE
These General Conditions govern the sale of PRODUCTS via the WEBSITE. The CUSTOMER is clearly informed and acknowledges that the WEBSITE is intended for consumers. Professionals can contact the SELLER in order to benefit from specific contractual conditions.
ARTICLE 3. ACCEPTANCE OF THE GENERAL CONDITIONS
The CUSTOMER undertakes to read these terms carefully and accept them, before proceeding to the payment of an ORDER of PRODUCTS.
These General Conditions are referenced at the bottom of each page of the WEBSITE by means of a link and must be consulted and expressly accepted before placing the ORDER. The CUSTOMER is invited to carefully read, download, print the General Conditions and keep a copy.
The SELLER advises the CUSTOMER to read the General Conditions for each new ORDER, the latest version of the said Conditions applying to any new PRODUCT ORDER.
By clicking on the "Order" button to place the ORDER, the CUSTOMER acknowledges having read, understood and accepted the General Conditions without limitation or condition.
ARTICLE 4. PRODUCTS
Article 4.1 Characteristics
All the PRODUCTS of the WEBSITE are detailed in the descriptions of the PRODUCTS and are accompanied by photos, in accordance with article L. 111-1 of the consumer code. These photos are not contractual and cannot call into question an order. Handmade PRODUCTS may have some differences due to their uniqueness. The colors of each screen and monitor may vary, the colors of the PRODUCT received may differ from the PRODUCT displayed on the site.
Article 4.2 Legal Guarantee of Conformity and Hidden Defects
The PRODUCTS received must conform to the expected use and the description made by the SELLER. In the event of a defect preventing the use of the PRODUCT or significantly modifying its visual appearance, please contact us via the contact form or directly by email at drawyourbliss(at)gmail.com. We may ask you to provide photographs and will replace or fully or partially refund (depending on the situation and the CUSTOMER's choice) the non-compliant PRODUCT.
In the event of a hidden defect which would make the PRODUCT unfit for the use for which it is intended or reduce its use, the SELLER undertakes to replace or reimburse totally or partially (depending on the situation and the CUSTOMER's choice) the said PRODUCT.
This does not concern PRODUCTS sold at a reduced price because they contain defects. This will then be explicitly stated and explained in the title and/or description of the PRODUCT.
Article 4.3 Price
The selling prices of the PRODUCTS indicated on the WEBSITE are expressed in euros, excluding processing and shipping costs. The selling prices of the PRODUCTS may be modified at any time. The PRODUCTS will be invoiced on the basis of the rates in force at the time of registration of the order. The DELIVERY costs will be indicated before the final validation of the order.
Article 4.4 Availability
The SELLER undertakes to honor orders received only within the limits of available stocks. If the PRODUCTS are no longer available, the SELLER undertakes to inform the CLIENT as soon as possible. The SELLER is likely to modify the salable assortment of the WEBSITE. The availability of PRODUCTS may vary on the same day depending on sales. The unavailability of the PRODUCTS will be notified on the article page of the PRODUCTS.
Article 4.5 Ownership
The SELLER remains the owner of the PRODUCTS delivered until full payment by the CLIENT and until the end of the bank withdrawal period, the PRODUCTS must be returned if necessary.
ARTICLE 5. ORDERS
To be able to purchase a PRODUCT, the CUSTOMER must be at least 18 years old and have legal capacity or, if he is a minor, be able to provide proof of the agreement of his legal representatives.
Article 5.1 Order procedure
The CUSTOMER chooses one or more PRODUCTS he wishes to order and adds them to his basket. The basket can be modified at any time before its validation. He then validates his basket. The CUSTOMER will have the possibility if he wishes to connect to his customer account, to create a new account or to place an order without an account. The CUSTOMER will then have to fill in his personal information such as his DELIVERY and billing address, his first and last names and any other information necessary for the DELIVERY of his ORDER. He can then choose his DELIVERY method, with or without tracking. Once he has made his choices, a total amount including shipping costs will be displayed and he will then be able to use a promotional code. The CUSTOMER will then choose his means of payment and proceed with the latter according to the terms of the chosen means of payment. Once the payment has been validated, a confirmation will be displayed on his screen and the CUSTOMER will also receive one by e-mail to the e-mail address provided when ordering or creating his account. The CUSTOMER will not receive any confirmation in paper format.
Article 5.2 Cancellation of order
The CUSTOMER has 12 hours to cancel his ORDER. Once this period has passed, the CUSTOMER can always withdraw by returning his ORDER under certain conditions (see ARTICLE 6. RIGHT OF WITHDRAWAL below).
ARTICLE 6. RIGHT OF WITHDRAWAL
Article 6.1 Right of withdrawal and form
In accordance with article L.121-21 of the consumer code, the CUSTOMER has the possibility of retracting for 14 days after the CUSTOMER has taken physical possession of the PRODUCTS ordered.
To exercise his right of withdrawal, the CUSTOMER must imperatively notify his right by completing the form below within the withdrawal period and sending it by e-mail to the address contact@drawyourbliss.com, via the contact form on the SITE or by post to the address:

Article 6.2 Effects of withdrawal
In the event of withdrawal, the SELLER undertakes to reimburse all sums paid no later than 14 days from receipt of the withdrawal form and receipt of the returned PRODUCTS. The SELLER will make the refund using the same means of payment as the CUSTOMER used for the initial transaction.
Article 6.3 Terms of return
The CUSTOMER must return the PRODUCTS no later than fourteen days following the communication of his decision to withdraw in accordance with article L. 121-21-3 of the Consumer Code, to the following address: Barbara MULLER, 5 rue Gabriel Pierné, 57000 METZ, FRANCE.
This deadline is deemed to have been respected if the CUSTOMER returns the PRODUCT before the expiry of the fourteen-day period.
Return costs will be borne by the CUSTOMER, who freely chooses the mode of transport to return his PRODUCT(s) to the SELLER.
Article 6.4 Packaging
The return of the PRODUCT(s) must be made in its original packaging, in good condition, suitable for its re-marketing, and be accompanied by all accessories and instructions, if any. The returned PRODUCT must also be in perfect condition. The responsibility of the consumer is engaged in the event of manipulations other than those necessary to establish the nature, characteristics and proper functioning of the goods.
Any return of incomplete, used or damaged PRODUCTS will authorize the SELLER to seek compensation from the CUSTOMER for its entire prejudice. The returned PRODUCT(s) must be packaged to transport standards in force guaranteeing maximum protection for the PRODUCTS during DELIVERY.
Article 6.5 Exclusions from the right of withdrawal
The right of withdrawal is excluded in the following cases:
Service goods whose price depends on financial market rates,
Goods made to your request or clearly personalized,
Goods that deteriorate or perish quickly,
Goods that the CUSTOMER has opened and cannot be returned for reasons of hygiene or health protection,
Goods inseparable from other articles,
Supply of newspapers, periodicals or magazines,
Digital content provided on an immaterial medium, the execution of which began with your agreement and for which you have waived your right of withdrawal. For example, a printable stationery kit.
ARTICLE 7. PAYMENTS
Article 7.1 Means of payment
The CUSTOMER can pay on the WEBSITE using the means made available to him by the SELLER. The CUSTOMER also guarantees that he is the authentic owner of the means of payment. Payments by credit card are made via the secure application of our service providers STRIPE and PAYPAL. All payment information provided on the SITE is transmitted to STRIPE and PAYPAL and is not processed on the WEBSITE.
Article 7.2 Date of payments
Payments are made only at the time of the order. The CLIENT's account will be debited as soon as the order for PRODUCTS is placed on the WEBSITE.
Article 7.3 PayPal
Payment via Paypal is made on Paypal's secure server. We refuse payment via Paypal if the DELIVERY address is different from the billing address, if this is not respected, the order(s) concerned will be cancelled.
ARTICLE 8. DELIVERY
Article 8.1 Zones de livraison
The PRODUCTS for sale on the WEBSITE can be delivered in mainland France and internationally. The CUSTOMER will be delivered to the DELIVERY address indicated by himself when registering the order or creating his account on the SITE.
Article 8.2 Error in delivery address
The SELLER is not responsible in the event of an error on the part of the CLIENT on the DELIVERY address. The customer has 12 hours after placing the ORDER to inform the SELLER of any error. In the event that the ORDER is returned to the SELLER for the reason of an incorrect address, the SELLER undertakes to reimburse the entire ORDER excluding shipping costs to the CUSTOMER once the order has been returned. In the event that the ORDER is not returned to the SELLER, the CUSTOMER will not receive any compensation or refund.
Article 8.3 Delivery methods
Our service provider for DELIVERY is "La Poste". The shipping costs are notified during the order confirmation. Standard SHIPPING does not include tracking. If you wish to have a follow-up, it will be available as a paid option when choosing DELIVERY.
Article 8.4 Packaging
The PRODUCTS sent are packaged in accordance with the standards in force so as to guarantee the protection of the PRODUCTS during DELIVERY.
Article 8.5 Shipping times
The ORDER will be prepared and sent within 5 days (excluding weekends and public holidays in France). The SELLER undertakes to notify the CUSTOMER in the event of a delay and to allow the CUSTOMER to cancel his order even after the 12-hour period in the event that the CUSTOMER does not wish to wait for the DELIVERY of his ORDER.
Article 8.6 Delivery times
The DELIVERY details can extend from 1 day to 1 month depending on the country of destination of the CLIENT's order. The SELLER cannot be held responsible for delays in the DELIVERY of the PRODUCTS ordered by the CLIENT. For more peace of mind, the SELLER advises the customer to opt for DELIVERY with tracking.
Article 8.7 Frais de Douanes
If the delivery is made outside the European Union, it is possible that the package will undergo customs clearance. Customs charges and other taxes must be paid by the CLIENT directly to the carrier. The SELLER is in no way responsible for delays and additional costs due to customs.
Article 8.8 Commande perdue
The SELLER declines all responsibility in the event of loss or problem during DELIVERY. Only ORDERS made with tracking are guaranteed against loss and theft.
ARTICLE 9. INTELLECTUAL PROPERTY
All the visual and sound elements as well as the very structure of the WEBSITE are protected under copyright/trademark rights, as well as under intellectual property.
Anyone wishing to create a hypertext link to the WEBSITE must request authorization in writing from the SELLER. This authorization is in no way final and may be revoked at the request of the SELLER. The link will therefore be removed.
ARTICLE 10. RESPONSIBILITY
The responsibility of the SELLER can in no case be engaged in the event of poor execution or non-performance of the contractual obligations attributable to the CLIENT, in particular during the entry of the order. In the event of force majeure, as defined by the case law of the French Courts, the SELLER cannot be held responsible for any delay or non-execution of orders. The SELLER excludes all responsibility for the information published on websites linked directly or indirectly to the WEBSITE.
ARTICLE 11. PERSONAL DATA
The submission of your personal information on our store is governed by our Privacy Policy which you can find by clicking on "Privacy Policy" in the footer menu on the WEBSITE.

ARTICLE 13. MODIFICATIONS TO THE GENERAL CONDITIONS OF SALE
These General Conditions apply to all purchases made online on the WEBSITE, as long as the WEBSITE is available online.
The General Conditions are dated precisely and may be modified and updated by the SELLER at any time. The applicable General Conditions are those in force at the time of the order.
Changes to the General Conditions will not apply to PRODUCTS already purchased.
ARTICLE 15. JURISDICTION IN APPLICABLE LAW
These General Conditions as well as the relations between the CLIENT and the SELLER are governed by French law.
In the event of a dispute, only the French courts will be competent.
